Real Life Somerville Police Stories:Yulial CUELLO-REYNOSO (Fugitive from Justice on Court Warrant, Fail to Stop)

   
 
On May 21, 2016, while assigned to the SPD Traffic Unit, operating subdued Traffic Unit Tango 2, in full uniform, I was performing a Selective Enforcement assignment at the intersection of Washington St. @ Somerville Ave. This particular intersection is a high violation intersection with regards to red light, illegal turn, and pedestrian cross walk violations. As I was situated on Somerville Ave, facing Union Sq. (westerly direction), I observed a red motor vehicle proceed through the red light on Washington St. (northerly direction). The operator clearly disobeyed the traffic control signal (red light) by @ 3-4 seconds. I had a clear and unobstructed view of the violation. I managed to pull the vehicle in the middle of Union Sq. opposite #59 Union Sq. The vehicle stop occurred in the far left hand lane of the 3 lane road. I observed the vehicle to be a red, 2014, Honda Accord, which is owned/operated by the defendant, Yulial A. Cuello-Reynoso of 3 Johnson Terr, Dorchester, Ma. 02121.

 

        I approached the operator/defendant and requested his license and registration. The defendant began to question the reason for the vehicle stop. He did not make any effort to retrieve the documentation. I asked again for the license and registration from the operator/defendant. He still questioned the reason for the vehicle stop and once again made no effort to produce the required documentation. At this time, I advised the defendant that he was required to produce his license and registration upon a Police Officer’s request/demand. I advised him that if he did not produce the necessary documentation that I was going to place him under arrest for Refusal to Produce. At this time, the defendant once again started to question the vehicle stop. I immediately got on my portable radio and requested back-up. As soon as the defendant observed me keying my radio, he immediately produced his license and then the vehicle registration. Car E-3 Off. Monaco, Car E-2 Off Ubeda, Car S-8 Sgt. Gobiel, and Car Delta 6 Det. Perrone arrived shortly afterward to back me up. A few minutes later, Somerville Control asked me if I had stopped the registered owner of the vehicle. I answered in the affirmative. I was informed that the registered owner/defendant could possibly have an outstanding warrant lodged against him from another jurisdiction. That jurisdiction would be Rhode Island. I was informed that there was an outstanding warrant out of Rhode Island for Carrying a Pistol without a License and the warrant was Extraditable from the New England states. Det. D. Dottin confirmed the status of the warrant with Mr. Frank Stratus of the Rhode Island Bureau of Criminal Identification, State Attorney General’s Office. Based upon the above stated circumstances, I placed the operator/defendant under arrest for the following charges: Fugitive from Justice and D.T.C.S. (red light).
