Real Life Somerville Police Stories: Nicholas FREDA (OUI Liquor, Refuse to Identify, Fail to Stop)

On Sunday, July 18, 2021, at approximately 7:00 P.M., Somerville Police control received three 911 calls regarding a white Mercedes traveling the wrong way on Prichard Ave. Prichard Ave is a public way in the city of Somerville.

One of the callers stated to the call taker that the operator of the white Mercedes exited his vehicle and approached her. The caller described the operator as a white male with a beard, wearing a black shirt, beige shorts, sneakers, and a hat.

Upon arrival, I found four vehicles standing in traffic at the intersection of Prichard Ave and Kidder Ave. I spoke to bystanders who stated to me that the white Mercedes was blocking traffic. I spoke to the operator of the vehicle directly behind the Mercedes (reporting party), and she told me that the operator of the white Mercedes was coming down the one way, she tried to get his attention to avoid a collision. The man exited his car, walked up to her, and called her names. I asked the reporting party what did the man say to her, and she replied: “He called me the ‘C’ word”. The reporting party also stated that the operator of the white Mercedes was doing calisthenics outside his car.

I approached the operator of the white vehicle and detected an odor of alcoholic beverage on his person. The operator has glassy eyes and slurred speech. I asked the operator to step out of the vehicle and he refused. To prevent the operator from leaving the scene and causing injury to himself or others, I reached inside the vehicle and turned the engine off then grabbed the operator’s left hand. I told the operator to step out and if he refuses I would have to use the force necessary to remove him from the vehicle. At this time the operator complied and exited the vehicle.

While talking to the operator, I noticed he was unsteady on his feet and had to lean against a parked vehicle. I asked the operator for his driver’s license and he refused to hand it to me. The operator stated: “Why are you doing this to me. I back you guys 100%”. I informed the operator that I believe he is driving under the influence of alcohol and that was the reason I removed him from the vehicle.

I asked the operator a second time to give me his license and refused. I informed the operator that I was placing him under arrest for OUI liquor and refusing to submit. The operator refused to place his hands behind his back. I grabbed the operator’s left hand, Officer Gee grabbed his right hand and we placed him in handcuffs (double-locked) without incident.

The operator was transported in unit 200 operated by Officer Anaya and was booked by Lieutenant Deoliveira. During the booking process, Lt. Deoliveira identified the operator as Nicholas FREDA. He advised him of his rights and asked him to submit to a chemical test of his breath. FREDA refused to take the test.

At the station, I asked FREDA to take field sobriety tests, he stated: “You are the asshole who arrested me”. FREDA refused to take the field sobriety tests. I issued citations # T2728028 and T2728029 to FREDA for OUI liquor, refuse to submit, one-way violation, and no seatbelt. FREDA was also issued a notice of suspension for a chemical test refusal.
